OBPA seeks to end rail contract

OGDENSBURG — The Ogdensburg Bridge and Port Authority wants to terminate a contract with the New York and Ogdensburg Railroad Company.

The OBPA issued a notice of termination to the railroad Tuesday, claiming the railroad is in breach of contract regarding maintenance of an antiquated locomotive.

OBPA Executive Director Wade A. Davis was reluctant to reveal details regarding the matter and refused to provide a copy of the termination letter.

"Unfortunately I can't provide a copy of the letter as it is a legal Notification of Termination between the Authority and the railroad," Mr. Davis said in an emailed response to the request.

David W. Wulfson, president of the Vermont Rail System, which operates the New York and Ogdensburg Railroad, said he was surprised by the notice.

"We were shocked to get the letter. We absolutely didn't expect it," he said. "We feel the OBPA is overreacting to a disagreement over the interpretation of a minor issue in the contract. We are hoping we can discuss this with them and come to an agreement."

Mr. Wulfson said the problem revolves around a defunct locomotive owned by the OBPA. The contract requires the rail company to maintain the equipment, but Mr. Wulfson said maintaining this particular locomotive is no longer cost effective and the railroad recommends purchasing a newer one.

"We maintain those engines for them, but it's come to a time where we recommend they do a major rehab on the locomotive or purchase a new one," he said.

Mr. Wulfson said the locomotive was the oldest one in operation on the New York and Ogdensburg Railroad and one of just two that are owned by the authority. He said it dates back to the 1950s and was purchased by the authority in 1984. He said it has surpassed its life expectancy.

Mr. Wulfson said the locomotive has been out of operation for approximately two years and has been substituted with a locomotive owned by the Vermont Rail System.

"We sent one of our engines there at no cost to the port," he said.

Mr. Wulfson said his goal is to resolve the matter and maintain services throughout the area.

"There is a conflict between us and the Port and I don't want the customers to be brought into it. We want to continue serving the community," he said.

Mr. Wulfson said the Vermont Rail System is eager to sit down with the OBPA and work this out. "To me, it is a minor issue that we should be able to resolve outside of court.
