Ex-convict rehabilitation bill facing RI Senate vote
PROVIDENCE — Over the attorney general’s strong objections, the Senate Judiciary Committee may vote Tuesday on a bill to give state judges the discretion to remove “legal impediments” from the path of ex-convicts seeking jobs, housing and state-issued professional licenses.
The bill is called the “Rehabilitation, Re-Entry and Public Safety Act,” and it begins with the premise that some of the restrictions currently on the books in Rhode Island “may be arbitrary, overboard and without regard to any post-conviction rehabilitation by a defendant.”
“In these cases,” the bill says, “employers and others who control access to opportunities and benefits may hesitate to give this population a second chance, thus inhibiting the successful reentry into society of those who have achieved their rehabilitation.
“Given the current ease of conducting background checks, it is harder and harder for people who have been convicted of a crime to escape their past, no matter how heroic their efforts to turn their lives around,” the bill states.
But Attorney General Peter F. Kilmartin, in a recent letter, warned the senators that the bill would “undermine existing statutes that require background checks for applicants who are seeking employment.”
Urging the lawmakers to look beyond the convicted criminal to the “public as a whole,” Kilmartin said: “Both private and public employers should have the opportunity to know the criminal history of an applicant, particularly where the applicant has engaged in repeated criminal conduct that has been admitted to in court.”
Simply put, the bill would allow a judge to issue a “certificate of rehabilitation” to anyone convicted of one or more crimes who, in years since his or her conviction, “has lived an honest and upright life, has conducted himself or herself with sobriety and industry, has exhibited good moral character, and has conformed to and obeyed the laws of the land.”
As to what a “certificate of rehabilitation” might do, the bill would give a judge a lot of discretion.
